Many recruitment agencies with contractors on their books will be affected by the Intermediaries’ Reporting Requirements. If you can answer ‘yes’ to all of these questions, then you do have to submit reports:
- Are you a recruitment agency?
- Do you engage contractors to provide services to your clients?
- Do any of these contractors work in the UK (excluding the UK continental shelf)?
- Do you make payments for these contractors’ services that you do not report via Real Time Information?
To make it even easier, we can tell you that if you trade with an Umbrella Company (including Key Portfolio), you are definitely required to submit reports.
HMRC may charge you a penalty if a report is missed, late, incomplete or incorrect.
